This copy of the AllPath Director Manager (“the Software Product”) and accompanying documentation is licensed and not sold. This Software Product is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. Fiber Mountain Inc. or its subsidiaries, affiliates, and suppliers (collectively “FMI”) own intellectual property rights in the Software Product. The Licensee’s (“you” or “your”) license to download, use, copy, or change the Software Product is subject to these rights and to all the terms and conditions of this End User License Agreement (“Agreement”).

YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY SELECTING THE “ACCEPT” OPTION AND DOWNLOADING THE SOFTWARE PRODUCT OR BY INSTALLING, USING, OR COPYING THE SOFTWARE PRODUCT.YOU MUST AGREE TO ALL OF THE TERMS OF THIS AGREEMENT BEFORE YOU WILL BE ALLOWED TO DOWNLOAD THE SOFTWARE PRODUCT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST SELECT “DECLINE” AND YOU MUST NOT INSTALL, USE OR COPY THE SOFTWARE PRODUCT.

This Agreement entitles you to install and use one copy of the Software Product. In addition, you may make one archival copy of the Software Product. The archival copy must be on a storage medium other than a hard drive, and may only be used for the reinstallation of the Software Product. This Agreement does not permit the installation or use of multiple copies of the Software Product, or the installation of the Software Product on more than one system at any given time, or on a system that allows shared used of applications. Multiple copy use or installation is only allowed if you obtain an appropriate licensing agreement for each user and each copy of the Software Product.

Without first obtaining the express written consent of FMI, you may not assign your rights and obligations under this Agreement, or redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer your rights to the Software Product.

You may not use, copy, or install the Software Product on more than one system, or permit the use, copying, or installation of the Software Product to any other system. If you hold multiple, validly licensed copies, you may not use, copy, or install the Software Product on any system with more than the number of computers permitted by license, or permit the use, copying, or installation by more users, or on more computers than the number permitted by license.

You may not decompile, “reverse-engineer,” disassemble, or otherwise attempt to derive the source code for the Software Product.

You may not modify the Software Product or create any derivative work of the Software Product or its accompanying documentation. Derivative works include but are not limited to translations. You may not alter any files or libraries in any portion of the Software Product.

You may not copy any part of the Software Product except to the extent that licensed use inherently demands the creation of a temporary copy stored in computer memory and not permanently affixed on storage medium. You may make one archival copy which must be stored on a medium other than a computer hard drive.

For a period of 90 days from the date of shipment or from the date that you download the Software Product, as applicable, FMI warrants that when properly installed and used under normal conditions, the Software Product will perform substantially as advertised.

UNLESS OTHERWISE EXPLICITLY AGREED TO IN WRITING BY FMI, FMI MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OTHER THAN AS SET FORTH IN THIS AGREEMENT OR IN THE LIMITED WARRANTY DOCUMENTS PROVIDED WITH THE SOFTWARE PRODUCT.

FMI makes no warranty that the Software Product will meet your requirements or operate under your specific conditions of use. FMI makes no warranty that operation of the Software Product will be secure, error free, or free from interruption. YOU MUST DETERMINE WHETHER THE SOFTWARE PRODUCT SUFFICIENTLY MEETS YOUR REQUIREMENTS FOR SECURITY AND UNINTERRUPTABILITY. YOU BEAR SOLE RESPONSIBILITY AND ALL LIABILITY FOR ANY LOSS INCURRED DUE TO FAILURE OF THE SOFTWARE PRODUCT TO MEET YOUR REQUIREMENTS. FMI WILL NOT, UNDER ANY CIRCUMSTANCES, BE RESPONSIBLE OR LIABLE FOR THE LOSS OF DATA ON ANY COMPUTER OR INFORMATION STORAGE DEVICE. TO THE EXTENT THAT THE APPLICABLE JURISDICTION LIMITS FMI’S ABILITY TO DISCLAIM ANY IMPLIED WARRANTIES, THIS DISCLAIMER SHALL BE EFFECTIVE TO THE MAXIMUM EXTENT PERMITTED

This Agreement is governed by the laws of New York, without regard to New York’s conflict or choice of law provisions.

This is a pluggable jar of stub classes representing the new Apple eAWT and eIO APIs for Java on Mac OS X. The purpose of these stubs is to allow for compilation of eAWT- or eIO-referencing code on platforms other than Mac OS X. The jar file is enclosed in a zip archive for easy expansion on other platforms.

These stubs are not intended for the runtime classpath on non-Mac platforms. Please see the OSXAdapter sample for how to write cross-platform code that uses eAWT.

OpenSSL is covered by one of two licenses, depending on which release is involved. In all cases, there is a file named LICENSE in the top-level of the release. Copies can also be found here.

NON-EXCLUSIVE SOFTWARE LICENSE AGREEMENT FOR MPLABÆ XC32 C COMPILER

This Nonexclusive Software License Agreement (“Agreement”) is a contract between you, your heirs, successors and assigns (“Licensee”) and Microchip Technology Incorporated, a Delaware corporation, with a principal place of business at 2355 W. Chandler Blvd., Chandler, AZ 85224-6199, and its subsidiary, Microchip Technology (Barbados) II Incorporated (collectively, “Microchip”) for the accompanying Microchip software including, but not limited to, MPLAB XC32 C Compiler, and any updates thereto (collectively, the “Software”), and accompanying documentation, including images and any other graphic resources provided by Microchip (“Documentation”).

1. Definitions. As used in this Agreement, the following capitalized terms will have the meanings defined below:
a. “Microchip Products” means Microchip 32-bit microcontrollers.
b. “Licensee Products” means Licensee products that use or incorporate Microchip Products.
c. “Object Code” means the Software computer programming code that is in binary form (including related documentation, if any), and error corrections, improvements, modifications, and updates.
d. “Source Code” means the Software computer programming code that may be printed out or displayed in human readable form (including related programmer comments and documentation, if any), and error corrections, improvements, modifications, and updates.

2. Software License Grant. Subject to Licenseeís compliance with the terms of this Agreement, Microchip grants strictly to Licensee a non-exclusive, non-transferable, worldwide license to:
a. Use the Software on a single computer in connection with Licensee Products; and
b. If Source Code is provided, modify the Software, provided that no Open Source Components (defined in Section 4 below) are incorporated into such Software in such a way that would affect Microchipís right to distribute the Software with the limitations set forth herein.

For purposes of clarity, Licensee may NOT incorporate or embed any portion of the Software into its own programs (including, for example, any extracts or other output of the Software), except however Licensee may incorporate extracts (in executable form) from any object libraries into Licensee Products.

3. Documentation License Grant. Microchip grants strictly to Licensee a non-exclusive, non-transferable, worldwide license to use the Documentation in support of Licensee’s authorized use of the Software.

4. Open Source Components. Notwithstanding the license grant in Section 2 above, Licensee further acknowledges that certain components of the Software may be covered by so-called “open source” software licenses (“Open Source Components”). Open Source Components means any software licenses approved as open source licenses by the Open Source Initiative or any substantially similar licenses, including without limitation any license that, as a condition of distribution of the software licensed under such license, requires that the distributor make the software available in source code format. To the extent required by the licenses covering Open Source Components, the terms of such license will apply in lieu of the terms of this Agreement. a. Standard Library Files. Notwithstanding the license grant in Section 2 above, Licensee acknowledges that ìlibc.aî, ìlibdsp.aî, ìlibe.aî, ìliblega-c.aî, and ìlibm.a,î library files (hereafter referred to as, ìStandard Library Filesî) are covered by third party licenses, as described below. To the extent required by the licenses for Standard Library Files, the terms of such license will apply in lieu of the terms of this Agreement. To the extent the terms of the licenses applicable to Standard Library Files prohibit any of the restrictions in this Agreement with respect to such Standard Library Files, such restrictions will not apply to such Standard Library Files.

The Standard Library Files are derived from software developed by Microchip, MIPS Technologies, and/or the University of California, Berkeley and its contributors. The following terms shall apply to Standard Library files:

(i) With respect to the portions of the Standard Library Files derived from software developed by MIPS Technologies (ìMIPS Filesî), Licensee agrees that use as described in Section 2 is permitted provided that Licensee complies with the remaining terms of this Agreement including the terms of subparagraphs (x)-(y) of this Section 4(a)(i):

Except as expressly and unambiguously allowed herein, Licensee will hold in confidence and not use or disclose any Proprietary Information and will similarly bind its employees in writing. Proprietary Information will not include information that: (a) is in or enters the public domain without breach of this Agreement and through no fault of the receiving party; (b) the receiving party was legally in possession of prior to receiving it; (c) the receiving party can demonstrate was developed by the receiving party independently and without use of or reference to the disclosing party’s Proprietary Information; or (d) the receiving party receives from a third party without restriction on disclosure. If Licensee is required to disclose Proprietary Information by law, court order, or government agency, License will give Microchip prompt notice of such requirement in order to allow Microchip to object or limit such disclosure. Licensee agrees that the provisions of this Agreement regarding unauthorized use and nondisclosure of the Software, Documentation and related Proprietary Rights are necessary to protect the legitimate business interests of Microchip and its licensors and that monetary damage alone cannot adequately compensate Microchip or its licensors if such provisions are violated. Licensee, therefore, agrees that if Microchip alleges that Licensee has breached or violated such provision then Microchip will have the right to injunctive relief, without the requirement for the posting of a bond, in addition to all other remedies at law or in equity.

8. Benchmarking. Licensee agrees that any disputes arising out of or related to this Agreement, Software or Documentation will be brought in the courts of the State of Arizona. This Agreement will constitute the entire agreement between the parties with respect to the subject matter hereof. It will not be modified except by a written agreement signed by an authorized representative of the Microchip. If any provision of this Agreement will be held by a court of competent jurisdiction to be illegal, invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. Use, duplication or disclosure by the United States Government is subject to restrictions set forth in subparagraphs (a) through (d) of the Commercial Computer-Restricted Rights clause of FAR 52.227-19 when applicable, or in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013, and in similar clauses in the NASA FAR Supplement.

2. **License Grant**:

Licensor hereby grants Licensee a Personal, Non-assignable & non-transferable, Commercial, Royalty free, Non-exclusive license, all with accordance with the terms set forth and other legal restrictions set forth in 3rd party software used while running Software.

2.1. **Limited**: Licensee may use Software for the purpose of:

2.1.1. Running Software on Licensee’s Website[s] and Server[s];
2.1.2. Distribute Software without any modification of the source code.

2.2. **Non Assignable & Non-Transferable**: Licensee may not assign or transfer his rights and duties under this license.

4. **Payment**:

In consideration of the License granted under clause 2, Licensee shall pay Licensor a fee, via Credit-Card, PayPal or any other mean which Licensor may deem adequate. Failure to perform payment shall construe as material breach of this Agreement.

5. **Upgrades, Updates and Fixes**:

Licensor may provide Licensee, from time to time, with Upgrades, Updates or Fixes, as detailed herein and according to his sole discretion. Licensee hereby warrants to keep The Software up-to-date and install all relevant updates and fixes. Licensor shall provide any update or Fix free of charge; however, nothing in this Agreement shall require Licensor to provide Updates or Fixes.

5.1. **Upgrades**: for the purpose of this license, an Upgrade shall be a material amendment in The Software, which contains new features and or major performance improvements and shall be marked as a new version number. For example, The Software under version 1.X.X, an upgrade shall commence under number 2.0.0.
5.2. **Updates**: for the purpose of this license, an update shall be a minor amendment in The Software, which may contain new features or minor improvements and shall be marked as a new sub-version number. For example, The Software under version 1.1.X, an upgrade shall commence under number 1.2.0.
5.3. **Fix**: for the purpose of this license, a fix shall be a minor amendment in The Software, intended to remove bugs or alter minor features which impair the The Software’s functionality. A fix shall be marked as a new sub-sub-version number. For example, Software under version 1.1.1, an upgrade shall commence under number 1.1.2.

6. **Support**:

Software is provided under an AS-IS basis and without any support, updates or maintenance. Nothing in this Agreement shall require Licensor to provide Licensee with support or fixes to any bug, failure, mis-performance or other defect in The Software.

6.1. **Bug Notification**: Licensee may provide Licensor of details regarding any bug, defect or failure in The Software promptly and with no delay from such event; Licensee shall comply with Licensor’s request for information regarding bugs, defects or failures and furnish him with information, screenshots and try to reproduce such bugs, defects or failures.
6.2. **Feature Request**: Licensee may request additional features in Software, provided, however, that
(i) Licensee shall waive any claim or right in such feature should feature be developed by Licensor;
(ii) Licensee shall be prohibited from developing the feature, or disclose such feature request, or feature, to any 3rd party directly competing with Licensor or any 3rd party which may be, following the development of such feature, in direct competition with Licensor;

(iii) Licensee warrants that feature does not infringe any 3rd party patent, trademark, trade-secret or any other intellectual property right; and
(iv) Licensee developed, envisioned or created the feature solely by himself.

7. **Liability**:

To the extent permitted under Law, The Software is provided under an AS-IS basis. Licensor shall never, and without any limit, be liable for any damage, cost, expense or any other payment incurred by Licensee as a result of Software’s actions, failure, bugs and/or any other interaction between The Software and Licensee’s end-equipment, computers, other software or any 3rd party, end-equipment, computer or services. Moreover, Licensor shall never be liable for any defect in source code written by Licensee when relying on The Software or using The Software’s source code.

8. **Warranty**:

8.1. **Intellectual Property**: Licensor hereby warrants that The Software does not violate or infringe any 3rd party claims in regards to intellectual property, patents and/or trademarks and that to the best of its knowledge no legal action has been taken against it for any infringement or violation of any 3rd party intellectual property rights.
8.2. **No-Warranty**: The Software is provided without any warranty; Licensor hereby disclaims any warranty that The Software shall be error free, without defects or code which may cause damage to Licensee’s computers or to Licensee, and that Software shall be functional. Licensee shall be solely liable to any damage, defect or loss incurred as a result of operating software and undertake the risks contained in running The Software on License’s Server[s] and Website[s].
8.3. **Prior Inspection**: Licensee hereby states that he inspected The Software thoroughly and found it satisfactory and adequate to his needs, that it does not interfere with his regular operation and that it does meet the standards and scope of his computer systems and architecture. Licensee found that The Software interacts with his development, website and server environment and that it does not infringe any of End User License Agreement of any software Licensee may use in performing his services. Licensee hereby waives any claims regarding The Software’s incompatibility, performance, results and features, and warrants that he inspected The Software.

9. **No Refunds**:

Licensee warrants that he inspected The Software according to above clauses and that it is adequate to his needs. Accordingly, as The Software is intangible goods, Licensee shall not be, ever, entitled to any refund, rebate, compensation or restitution for any reason whatsoever, even if The Software contains material flaws.

10. **Indemnification**:

Licensee hereby warrants to hold Licensor harmless and indemnify Licensor for any lawsuit brought against it in regards to Licensee’s use of The Software in means that violate, breach or otherwise circumvent this license, Licensor’s intellectual property rights or Licensor’s title in The Software. Licensor shall promptly notify Licensee in case of such legal action and request Licensee’s consent prior to any settlement in relation to such lawsuit or claim.

11. **Governing Law, Jurisdiction**:

Previously, the copyright and/or licensing status of the Python Cryptography Toolkit (“PyCrypto”) had been somewhat ambiguous. The original intention of Andrew M. Kuchling and other contributors has been to dedicate PyCrypto to the public domain, but that intention was not necessarily made clear in the original disclaimer (see LEGAL/copy/LICENSE.orig).

Additionally, some files within PyCrypto had specified their own licenses that differed from the PyCrypto license itself. For example, the original RIPEMD.c module simply had a copyright statement and warranty disclaimer, without clearly specifying any license terms. (An updated version on the author’s website came with a license that contained a GPL-incompatible advertising clause.)

To rectify this situation for PyCrypto 2.1, the following steps have been taken:

1. Obtaining explicit permission from the original contributors to dedicate their contributions to the public domain if they have not already done so. (See the “LEGAL/copy/stmts” directory for contributors’ statements.)

2. Replacing some modules with clearly-licensed code from other sources (e.g. the DES and DES3 modules were replaced with new ones based on Tom St. Denis’s public-domain LibTomCrypt library.)

3. Replacing some modules with code written from scratch (e.g. the RIPEMD and Blowfish modules were re-implemented from their respective algorithm specifications without reference to the old implementations).

4. Removing some modules altogether without replacing them.
